Tongaat Hulett application struck from roll for lack of urgency

Tongaat Hulett Limited (THL) announced that an application instituted by RGS Group Holdings Limited (RGS) against THL and its business rescue practitioners (BRPs) was struck off the roll for lack of urgency on September 16, 2025. The High Court of South Africa, KwaZulu-Natal Local Division, Durban, found that RGS failed to meet the necessary requirements for the application to be adjudicated as a matter of urgency.

The court also ruled that RGS is to pay the THL respondents' costs on the C Scale, including the cost of two counsel. Additionally, the costs related to the THL respondents' application in terms of Uniform Rules 47(3) and 47(4), heard on September 3, 2025, have been reserved.
